Information notice pursuant to Article 13 of EU Reg. no. 2016/679
European Regulation no. 2016/679 on the protection of personal data and Italian Legislative Decree no. 196 of 30 June 2003, the "Personal Data Protection Code", provide for the right to the protection of personal data.
Elicapital Srl, with registered office in Rome – Via Bellini no. 2, 00198, VAT no. 13673711001, in its capacity as Data Controller, hereby informs the users of the website www.elicayachts.it about the processing of personal data.
PROVIDES NOTICE
To the user/visitor of the website, hereinafter referred to as the Data Subject, that in relation to the use of the website www.elicayachts.it (the "Site") and any submission of their personal and contact data through forms present on it, the transmitted data will be processed in accordance with the following information notice:
1. TYPES OF DATA PROCESSED
While browsing the Site, the Controller may acquire information about the Data Subject in the following ways:
a) Browsing data
The IT systems and software procedures responsible for the operation of the Site acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. These data are processed to operate the Site and to keep it secure.
Visit measurement with Vercel Web Analytics, described in section 5, is not part of this technical protocol data and takes place only after consent.
b) Data provided by the visitor/user
This includes all personal data provided by the visitor through the Site: by filling in the contact form provided therein and/or by phoning/sending e-mails to the contact details indicated by the Controller in the "contacts" area and/or by filling in the form to apply for job positions.
2. PURPOSES AND METHODS OF DATA PROCESSING
The processing of personal data, collected through the Site and provided by the Data Subject voluntarily and in connection with this information notice, will be based on the principles of fairness, lawfulness, and transparency.
a) Basic purposes:
- to provide Data Subjects with the features and information available on the Site;
- to provide Data Subjects with support and information on the Controller's services;
- to keep the information within the company's archives up to date;
- to give Data Subjects the opportunity to apply for the "open positions" within the company.
b) Additional purposes – marketing:
The collected data may also be processed by the company, subject to the explicit and free consent of the Data Subject, for marketing and profiling purposes.
3. MANDATORY AND OPTIONAL NATURE OF PROVIDING DATA
Providing data for the basic purposes is mandatory for the proper functioning of the Site. Providing data for marketing purposes is entirely voluntary and not mandatory.
4. SCOPE OF COMMUNICATION AND DISSEMINATION OF PERSONAL DATA
The personal data collected may be communicated to consultants, suppliers, and any other parties to whom current legal and/or contractual regulations impose an obligation of communication. The personal data collected will not be disseminated, unless required by a law or regulation or by EU legislation.
Only if the Data Subject has consented to visit measurement are the related data communicated to Vercel Inc. as processor, on the terms of section 5.
5. AUDIENCE MEASUREMENT
If the Data Subject presses "Accept" in the banner, the Controller measures use of the Site in aggregate form with Vercel Web Analytics.
Data: pages visited, referring page, device type, operating system, browser, date and time, approximate location (country, region, city) derived from the IP address. No measurement cookie and no advertising identifier are used. Vercel keeps a hash of the request for no more than 24 hours in order to count the visit, and does not show the IP address to the Controller.
Purpose: aggregate traffic statistics, with no advertising profiling and no cross-site matching.
Legal basis: the Data Subject's consent (Art. 6(1)(a) of EU Regulation 2016/679 and Art. 122 of Legislative Decree 196/2003). Consent is optional: refusing it does not prevent use of the Site. The tool is not strictly necessary and cannot be treated as a technical cookie under the Italian Authority's guidelines of 10 June 2021 and EDPB Guidelines 2/2023 (7 October 2024).
Recipient: Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, United States, acting as processor. The transfer to the United States takes place, according to Vercel's notice of 1 June 2026, under the EU-US Data Privacy Framework.
Retention: session hash for at most 24 hours; aggregate statistics for as long as the service is used.
Rights: access, rectification, erasure, restriction, objection and portability, within the limits of the law, and withdrawal of consent at any time from the Cookie Policy, without affecting the lawfulness of processing before withdrawal. Complaint to the Italian Data Protection Authority (www.garanteprivacy.it). These rights may be exercised through the Controller's contact details shown on the Site.
